Terms of Service

Thank you for using TrixMall! These Terms of Service ("Terms") outline the rules and restrictions governing your use of our products, services, and website ("Services"). These Terms constitute a binding agreement between you and us. By completing the registration process and/or browsing the Services, you indicate that (1) you have read, understood, and agree to be bound by these Terms; (2) you are of legal age to enter into a binding contract with us; (3) you have the authority to agree to these Terms on a personal basis; and (4) if you are using the Services on behalf of a company or other entity, (a) "you" includes you and that entity, (b) you are an authorized representative of that entity with the authority to bind the entity to these Terms, and (c) you agree to these Terms on behalf of the entity. If you do not agree to comply with all of these Terms, you should not access or use the Services.

1. Overview

1.1 These Terms constitute an agreement between you and TrixMall, a company registered in China.

1.2 In these Terms and Policies (as defined below), TrixMall is referred to as "we."

In these Terms and Policies, we also refer to:

• Our website, which may offer features, products, services, or content, including communication of information, referred to as "TrixMall";
• End users, including visitors to TrixMall and users who purchase products through TrixMall, referred to as "you."

1.3 We and our affiliates provide technical and operational support for our website. You can pay for multiple orders with a single transaction on TrixMall. Multiple orders may be shipped together in one package.

1.4 Your use and participation in certain Services may be governed by additional policies ("Policies") that we publish from time to time, including our Privacy Policy. In the event of any conflict between the Terms and Policies, the Policies will prevail.

1.5 We reserve the right to modify these Terms, at our sole discretion, from time to time, or to add new terms without notice to you. Such modifications or additions will take effect immediately upon notification, which may be provided in any form, including but not limited to posting the revised Terms on the TrixMall website. You are responsible for checking the TrixMall website for any changes to the Terms that may affect your rights or obligations. Any changes or modifications will become effective immediately upon posting on the website. Your continued access or use of the TrixMall website after changes to these Terms will constitute your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the website.

2. User Requirements and Registration

2.1 To use the Services, you represent that you are at least eighteen (18) years old and of legal age to enter into a binding contract. TrixMall may sell products intended for children’s use; however, such products are intended for purchase by adults. Certain products may be designed for specific age groups or "mature audiences." By ordering such products, you confirm that you are of sufficient age to view, use, possess, or receive those products. We are not responsible for any third-party content you may find offensive, obscene, or objectionable.

2.2 You may not use the Services if you are unable to enter into a binding contract with us, or if you have been prohibited from using the Services for violating these Terms or for any other valid reason.

2.3 You may be required to create an account and select a password and username. When creating an account on TrixMall ("Account"), you agree to provide truthful, accurate, complete, and current personal information, including contact details. You are responsible for keeping your registration information up to date. You are responsible for all activities that occur under your account. You agree to monitor your account to prevent unauthorized use by minors, and you are fully responsible for unauthorized use of the Services by minors. You must not choose a name as your username to which you have no rights, or use another person’s name with the intent to impersonate them. You must not transfer your account to another person without our prior written consent. If you have been permanently banned from using any of the Services, you agree not to create another account or use the Services. You must not share your account or password with anyone and agree to notify us immediately of any unauthorized use of your password or any other breach of security, and to log out of your account at the end of each session. When creating an account, contract details related to the account will be displayed before submitting the registration request, and you will have the opportunity to correct the registration information before submitting the request. We reserve the right to accept or reject all registration requests, and no claims shall be made based on registration requests. A contract related to your registration on TrixMall becomes effective when we confirm your registration via email or other means.

2.4 The language applicable to these Terms is the language version you select when using TrixMall.

2.5 The current version of the Terms will always be displayed, and you have the right to print or save an electronic copy.

3. Rules and Restrictions

3.1 You agree to use the Service only for your own use and not on behalf of any third party or for the benefit of any third party, and to use it only in compliance with these Terms, Policies, and all applicable laws and regulations. If your use of the Service is prohibited by any applicable law, you are not authorized to use the Service. We accept no liability for any use of the Service that violates the law.

3.2 You are responsible for any damages caused by third-party use of your account unless you have taken all reasonable precautions to prevent such use. Therefore, you must protect the security of your account and password and must not share them with any third party. You must immediately notify us of any unauthorized use of your account or any security breaches.

3.3 Any promotions provided through the Service, including lotteries, contests, raffles, surveys, games, or similar promotional activities (collectively referred to as "Promotions"), may have separate rules. In case of a conflict between the rules of the Promotions and these Terms, the rules of the Promotions shall prevail.

3.4 When using the Service, you agree and undertake not to engage in any actions or submit any User Content through the Service that may:

• infringe or violate the rights of others, including intellectual property rights;
• violate these Terms, Policies, or applicable laws and regulations;
• engage in any unlawful, harmful, abusive, misleading, false, fraudulent, deceptive, threatening, harassing, defamatory, disparaging, pornographic, obscene, blasphemous, or other objectionable or discriminatory conduct;
• circumvent or attempt to circumvent these Terms, Policies, or any other rules related to the Service, including Promotions;
• constitute unauthorized or unsolicited advertising, or spam or bulk mail;
• collect personal data from other users or use any such information collected through the Service;
• engage in any actions that may lead to a security breach of your account;
• obtain passwords, accounts, or other security information from other users;
• use third-party credentials, disguise your true IP address, or otherwise impersonate or falsely represent your identity or your relationship with any person or entity;
• violate or interfere with the normal operation or security of any computer network;
• run any form of automated response program or "spam" on the Service, any process that runs or is activated while you are not logged into the Service, or otherwise interfere with the normal operation of the Service (including imposing an unreasonable burden on the Service through overload, "flooding," "mail bombing," or crashing);
• potentially damage the Service, including but not limited to the use of any security feature, accessing, "crawling," "scraping," or "spidering" any page, data, or part of the Service by manual or automated software or other means, or introducing viruses, worms, or other harmful code to the Service;
• copy or store any substantial content from the Service without our written consent;
• decompile, reverse engineer, or otherwise obtain the source code or underlying ideas or information related to the Service;
• purchase any product that you are legally prohibited from purchasing or using;
• abuse any promotions, discounts, or other benefits we provide, or manipulate any prices of listed products or interfere with product information; or
• attempt to do anything prohibited or allow, encourage, assist, or permit any third party to do anything prohibited.

In addition to any other remedies available to us, violations of any of the above provisions will result in:

• deletion or refusal to post any User Content;
• cancellation of products you purchased;
• cancellation of any rewards or payments you were entitled to receive; and/or
• suspension or termination of your access to or use of the Service.

If we find that you may have violated these Terms, we reserve the right to investigate such violations. If, after investigation, we believe that criminal activity has occurred, we reserve the right to report the matter to all applicable law enforcement authorities and cooperate with them. We have the right to disclose any information or materials you provide while using the Service, including User Content, to (i) comply with applicable laws, legal processes, or government requests; (ii) enforce these Terms and Policies; (iii) respond to any claims regarding User Content infringing third-party rights; (iv) respond to your customer service requests; or (v) protect our rights, property, or personal safety, or those of our users or the public, as well as any law enforcement or other government officials, as we deem necessary or appropriate.

4. Privacy

4.1 Our Privacy Policy provides information about how we collect, use, and disclose your personal information when you access, visit, or use the Service. By using the Service, you acknowledge and agree that we may collect, access, use, store, and disclose your personal information (including your account and user information) as described in the Privacy Policy. The Privacy Policy is part of these Terms and is governed by them. By agreeing to these Terms, you also agree to be bound by the terms of the Privacy Policy.

5. Communication

5.1 You agree to receive our communications electronically, such as emails, text messages, push notifications, and notifications and messages sent through the Service ("Push Messages"). Where legally required, we will obtain your consent to send these Push Messages. You acknowledge that your wireless service provider may charge fees for data, text messages, and/or other wireless access, including charges related to Push Messages, when using the website. Please confirm with your wireless service provider the fees applicable to your access and use of the Service, including receiving our Push Messages. You are responsible for any fees, costs, or expenses incurred as a result of using the Service, including charges for receiving Push Messages. You acknowledge and agree that all terms and conditions, agreements, notices, disclosures, and other communications and documents we provide to you electronically have the same legal effect as if they were provided in "written form."

5.2 You agree that we may communicate with you through any email address or phone number you provide to: (i) notify you about your account; (ii) resolve issues with your account; (iii) address disputes; (iv) collect payments; (v) solicit your feedback through surveys or questionnaires; (vi) inform you about updates regarding orders, payments, and deliveries; (vii) send you verification text messages; or (viii) otherwise serve your account or enforce these Terms, policies, applicable laws and regulations, or other agreements we may have with you. Your mobile carrier will charge standard messaging fees for the text messages we send.

5.3 If you wish to receive our marketing materials via mobile text messages and alerts, you may register. By registering, you agree to receive promotional messages or other mobile information sent on your behalf, including one-time verification codes, order notifications, our promotional messages, and abandoned cart reminders (enabled through cookies collected in accordance with these Terms). Opting into one program does not automatically mean you are opting into other programs. Message frequency may vary, and carriers are not responsible for any delays or undelivered messages. Information and data charges may apply. You acknowledge that you are not required to agree to receive marketing text messages as a condition of using the Service. You may unsubscribe from our text messages; however, you acknowledge that opting out may affect your use of the Service. You may also re-subscribe. We will not share your consent, opt-in, and opt-out records with any third party, except for text message service providers and aggregators. For further assistance, please contact us. 5.4 Our communications with you may be conducted through third-party service providers. You acknowledge and agree that, in accordance with our Privacy Policy, communications between you and us or our agents may be recorded, monitored, and stored for quality control and training purposes or to protect your and/or our interests.

6. User Submissions

6.1 "User Submission" refers to any content posted, uploaded, shared, submitted, stored, or otherwise provided through the Service, including suggestions, comments, reviews, photos, videos, or other feedback or materials that may be viewed by other users. Any User Submission you post in your account must not contain nudity, violence, sexual innuendo, or any offensive subject matter, as determined by us in our sole discretion. For all User Submissions, you grant us a fully paid, royalty-free, non-exclusive, transferable, sublicensable, worldwide right and license (including any moral rights) to use, license, store, display, reproduce, save, modify (such as ensuring User Submissions are visible across different systems and devices), create derivative works, publicly perform, publicly display, distribute, translate, or otherwise process such User Submissions in any manner we deem necessary for the operation, marketing, and advertising of our services, including displaying, showing, or performing these User Submissions based on your preferences, in compliance with applicable data protection laws.

6.2 You acknowledge and agree that all User Submissions (including the username you use) are non-confidential and non-proprietary. We may freely display, disclose, copy, modify, license, transfer, distribute, and otherwise use User Submissions to operate TrixMall or provide the services without any compensation to you.

6.3 You represent that you own or otherwise control all rights to the User Submissions and that our use of any User Submission will not infringe or violate any rights of any third party, nor violate any rules or restrictions in these Terms (including the terms outlined in Section 3).

6.4 We do not endorse User Submissions, and they do not represent our views. We expressly disclaim any responsibility for User Submissions or any damages arising from them. We expect users to maintain a high level of integrity when submitting User Submissions that can be viewed by other users, especially when reviewing and commenting on products. You represent that User Submissions viewable by other users are true, made in good faith, and based solely on your personal experience. You further agree to clearly indicate if any User Submission has been sponsored or paid in any way. You acknowledge that we have no obligation to pre-screen User Submissions, although we reserve the right to pre-screen, reject, exclude, or remove any User Submission. By agreeing to these Terms, you irrevocably consent to such monitoring. If we pre-screen, reject, exclude, or remove any User Submission, you acknowledge that we are doing so for our benefit, not yours. Without limiting the foregoing, we reserve the right to remove any User Submission that violates these Terms or is otherwise objectionable.

7. Ownership

7.1 You acknowledge and agree that all materials displayed, performed, or accessible through the Service, including but not limited to text, graphics, data, articles, photos, images, illustrations, and User Submissions (collectively referred to as "Content"), are protected by global copyright and/or other intellectual property laws. You agree to comply with all copyright notices, trademark rules, information, and restrictions contained in the Content, and you shall not copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell, or use any Content that does not belong to you for any purpose without the prior consent of the owner of that Content.

7.2 We respect the intellectual property rights of others and reserve the right to remove or disable Content that allegedly infringes the intellectual property rights of others, as well as to terminate the accounts of repeat infringers.

7.3 You acknowledge and agree that we own or license the Service. Except as explicitly stated in this Section 7, you shall not modify, publish, transmit, participate in the transfer or sale, copy, create derivative works of, or otherwise exploit any part of the Service.

7.4 Subject to your compliance with these Terms and all applicable policies, rules, and guidelines, and upon payment of any applicable fees, we or our Content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service solely for personal, non-commercial purposes while using TrixMall. We or our licensors, suppliers, publishers, rights holders, or other Content providers reserve and retain all rights not expressly granted to you. If you do not comply with these Terms or any applicable policies, rules, or guidelines, the license granted to you will terminate.

7.5 You shall not use any information provided through the Service for commercial purposes or for the benefit of other businesses without our prior express permission. You shall not solicit, advertise, or contact users in any form for purposes unrelated to the services facilitated through TrixMall. If you violate this provision, we reserve the right to refuse service, terminate accounts, and/or cancel transactions.

8. Liability; Third-Party Risks

8.1 You acknowledge and agree that any content publicly posted or privately transmitted through the Service is the sole responsibility of the person who posted or transmitted that content. You assume all risks associated with accessing and using such content and interacting with other users. We are not responsible for any errors, omissions, or inaccuracies in the content. We do not control the content and have no obligation to take any action to dictate how you interpret, use, or respond to the content. We have no obligation to review or monitor the content and do not endorse, support, or make any representations or warranties regarding the content. You also understand that we cannot guarantee the identity of users with whom you interact while using the Service and are not responsible for which users can access the Service.

8.2 You are solely responsible for all content you contribute to the Service in any way, and you represent and warrant that you have all rights to contribute such content to the Service in this manner.

8.3 The Service may contain links or connections to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, accuracy, privacy policies, or practices of any third-party websites or services, or for the opinions expressed therein. Additionally, we do not and cannot monitor, verify, review, or edit any content of third-party websites or services. You acknowledge and agree that any risk arising from your access to or use of any third-party websites or services is solely yours. We recommend that you pay attention when leaving the Service and read the terms of use and privacy policies of each third-party website or service you visit or use.

8.4 Any interactions you have with other users, entities, or individuals as a result of using the Service, including communications, payments, performance, and delivery, are solely between you and those third parties; however, we reserve the right but have no obligation to intervene in these interactions. You should conduct appropriate due diligence and/or seek professional advice before engaging with any of these third parties. You acknowledge and agree that we are not responsible for any loss or damage incurred as a result of these interactions. You agree that we will not be liable for any responsibilities arising from these interactions.

8.5 Arranging sales or payments with third parties for listed goods in order to circumvent the obligation to pay for products purchased through the Service is a serious violation of these Terms.

9. Disclaimer

9.1 We are not liable for any claims or disputes that may arise between TrixMall users. If you have a dispute with other users or any third parties on TrixMall, we have no obligation to intervene.

10. Purchase

10.1 You are responsible for reading the complete product listing before purchasing any products. By confirming your purchase, you agree to pay all applicable fees, taxes, shipping charges, and any other costs associated with your purchase. Additionally, if applicable, you acknowledge your responsibility for sales tax, value-added tax (VAT), and customs duties. Ownership of the product transfers to you when the product is delivered to the carrier. You agree that, if applicable, you will act as the importer of the purchased product and authorize us to designate a freight forwarder as your direct representative to pay any sales tax, VAT, and customs duties on your behalf. Please note that the sales tax, VAT, customs duties, and similar fees collected at the time of purchase are estimates and may vary according to applicable laws. You are responsible for any additional costs incurred. We are not responsible for any delays or refusals of customs clearance resulting from your failure to pay such fees.

10.2 Although we strive to ensure that the information provided on TrixMall is accurate, there may be printing errors, inaccuracies, or omissions related to pricing, product descriptions, availability, and promotions. According to applicable laws, we reserve the right to correct any errors, inaccuracies, or omissions at any time and to change or modify information or cancel orders or parts of orders without prior notice, including after you have submitted your order or received an order confirmation or shipping notice. You should not rely on strikethrough prices when making a purchase decision. If price comparison is critical to your purchase decision, you should conduct your own comparison before buying.

10.3 Please thoroughly review all descriptions and restrictions of the products you are interested in before placing an order. If you have any special circumstances (such as medical or health conditions and/or special needs) that may affect or be affected by the products you wish to purchase, you are responsible for informing us before placing your order.

10.4 We make reasonable efforts to ensure that the colors of products displayed on TrixMall are as accurate as possible. However, we cannot guarantee that your monitor's display of any color will accurately reflect the color of the products you choose to purchase.

10.5 You acknowledge that the products meet the requirements for the transaction or intended purchase if they: (i) conform to the descriptions provided on TrixMall and have the quality displayed on TrixMall; (ii) are suitable for the purposes commonly associated with such products; and (iii) have the normal quality and performance expected of similar types of products and meet reasonable expectations.

10.6 To make a purchase, you must provide accurate and complete information about a valid payment method and ensure that you have the right to use that payment method. You must promptly update any changes related to the payment method in your account. By providing payment method information, you authorize us or our agents or payment service providers to charge the payment method for: (A) the amount due for the products purchased; (B) any and all applicable customs duties, taxes, and shipping fees; and (C) any other charges incurred while using the service. We may refuse, freeze, or hold your transaction for any reason, including suspected fraud, anti-money laundering, and sanction compliance, or if we believe your transaction poses a risk to us or any third party.

10.7 The payment processor may charge you fees for purchases made through TrixMall. These processing fees will be disclosed to you via TrixMall. Your use of the service and the payment processing services provided by the payment processor is subject to the agreement you have with the payment processor, which may be modified at any time. As a condition of using the payment service, you must provide accurate and complete information and authorize us to share that information with the payment processor.

10.8 Once the payment amount you agreed upon is received, your payment obligation is considered fulfilled.

11. Refunds, Exchanges, and Related Matters

11.1 We provide customer service support related to product purchases, including payment, returns, refunds, and other related areas.

11.2 We hope you are satisfied with the products purchased through our service platform. For all products purchased on TrixMall, you may have the right to return and request a refund. For detailed information about returns and refunds, please visit our Return and Refund Policy. If you wish to request a refund, please follow the instructions in the policy. You acknowledge and agree that we may issue refunds to you according to the Return and Refund Policy.

Unless otherwise specified in the Return and Refund Policy, refunds do not include any customs fees, taxes, or return shipping costs that you may incur during the refund process.

12. Rewards

12.1 You may earn points, coupons, cash, gifts, or other forms of rewards (collectively referred to as "Rewards") by using the service. Some rewards may only be eligible for discounts or payments on qualifying purchases made on or through the service (please note that not all products qualify), and unless required by law, they cannot be redeemed for cash. You should carefully read the information and applicable rules regarding the different types of rewards.

13. Termination of Our Relationship

13.1 You may stop using the service at any time. We also have the right, at our sole discretion, to terminate or suspend your access to the service or your account for any reason, including if you violate these terms. Even after you stop using the service, these terms will remain binding on you, and any unpaid amounts owed to us must still be paid.

13.2 If your account is terminated, all content and rewards associated with your account will be forfeited and canceled. You should attempt to use any remaining rewards before the termination becomes effective.

13.3 All provisions of these terms that, by their nature, should survive termination will remain in effect after termination, including but not limited to ownership provisions, disclaimers, and limitations of liability.

14. Limitation of Liability

14.1 We are only liable to you for contractual obligations arising from the provision of services. Under no circumstances shall we be liable for the actions or inactions of any third parties.

14.2 Our liability to you is governed by the following rules:

• We are fully liable for damages caused by our own actions, or those of our employees and agents, that are intentional or due to gross negligence, as well as for damages arising from fraudulent concealment of defects, explicit warranties, and personal injury (including life, body, and health).
• For other damages, we are only liable when they result from a breach of obligations necessary for the performance of the agreement, which the other party could generally rely on. Furthermore, our liability for such other damages is limited to typical and foreseeable damages that arise from the contract. Any potential liability under product liability laws remains unaffected. Any further liability is excluded.
• We do not guarantee or assume liability for obligations related to convenience contracts with any third party.
• Additionally, we are not liable for the accuracy, reliability, or completeness of any content provided free of charge on TrixMall, or for any damages arising from such content.

15. Indemnification

You agree to indemnify us against any and all claims made by other users or third parties based on your use of the services or your violation of these terms. In the event of indemnification under this clause, you shall bear our necessary legal defense costs. This clause does not apply in cases where you are not responsible for the claim. In the event of any indemnification claim described in Section 15 of these terms, you must provide us with all necessary information immediately and accurately so that we can review and defend against the claim.

16. General Provisions

16.1 Assignment. You may not assign, delegate, or transfer these terms or your rights and obligations under them in any way (by operation of law or otherwise) without our prior written consent. Any such assignment, subcontracting, delegation, or transfer in violation of this provision shall be null and void. We may assign, delegate, or transfer these terms and our rights and obligations under them to any other person without your consent.

16.2 Force Majeure. We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, actions of civil or military authorities, fire, floods, accidents, epidemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

16.3 Governing Law. If you are a resident of an EU country, these terms and any disputes arising between you and us shall be governed by the laws of that country. If you are a resident outside the EU, these terms and any disputes arising between you and us shall be governed by the laws of China. The United Nations Convention on Contracts for the International Sale of Goods does not apply to the agreement between you and us or these terms.

16.4 Online Dispute Resolution. The European Commission provides an online dispute resolution platform (the "ODR platform"). In the event that the service or application is subject to this regulation, we are not willing and not required to participate in dispute resolution procedures before consumer arbitration bodies.

16.5 Notices. You acknowledge and agree that we may send notices to you via the most recent email address you provided, which constitutes valid notice. Therefore, it is your responsibility to keep your email address information updated with us.

16.6 Waiver. Our failure to respond to any breach by you or others shall not be construed as a waiver of our right to act with respect to subsequent or similar breaches.

16.7 Severability. If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these terms remain in full force and effect and enforceable.

16.8 No Third-Party Beneficiaries. No third-party beneficiaries are created by these terms.

16.9 Entire Agreement. These terms constitute the final, complete, and exclusive agreement between the parties regarding the subject matter hereof and supersede and merge all prior discussions between the parties regarding the subject matter.

16.10 Translation. The translated versions of these terms of use, privacy and cookie policies, intellectual property policy, or other terms or policies are provided for your reference only. In the event of any discrepancy between the English version and other language versions, the English version shall prevail.
